General Conditions
These General Conditions of Sale (hereinafter the General Conditions) have as their object the discipline of the purchase of products, carried out remotely and made available, via the internet, from the site www.carellaostuni.com (hereinafter the Site).
All purchases of products made through the Site (hereinafter the Purchase Agreements) by the users who access it (hereinafter, the Customers) are governed by the following General Conditions as well as by the other provisions and operating instructions contained on the Site.
Before carrying out each purchase, Crisma Srl invites each Customer to carefully read these General Conditions and, once the purchase procedure provided by the Site is concluded, to print them and to keep a copy or save in electronic copy.
Without prejudice to the provisions of article 49, paragraph 5 of the Consumer Code, Crisma Srl may modify, at any time and without notice, the content of the General Conditions referred to in this document. Any changes made will be effective from the date of publication on the Site and, except for the most favorable changes for the Customer, will only be applicable to the contractual proposals (or orders) of purchase sent by the Customer after the date of publication.
1. Purchase procedure
The Customer can purchase the products present in the electronic catalog of Crisma Srl, illustrated in detail and described in the relevant information sheets contained on the Site, respecting the technical access procedures illustrated therein. The publication of the products and services displayed on the Site constitutes an invitation addressed to the Customer to formulate a contractual purchase proposal. The order sent by the customer has the value of a contractual proposal and implies full knowledge and full acceptance of these General Conditions.
The correct receipt of the Customer's proposal is confirmed by Crisma Srl through an automatic reply sent to the email address communicated by the Customer and only confirms the correct receipt of the proposal within the information systems. This confirmation message will indicate an Order Number, to be used in any subsequent communication with Crisma Srl. The message reproposes, in addition to the information required by law, all the data entered by the Customer, who undertakes to verify its correctness and communicate promptly any corrections.
Each order can be viewed by the Customer on the Site, in his own personal area called Account, immediately after sending the order. Until the moment of order fulfillment by Crisma Srl (communicated to the Customer via email and through the updating of the information contained in his personal area) the Customer has the right to modify or cancel the order, exclusively through the specifications access and modification functions foreseen in the personal area.
Each Purchase Agreement stipulated between Crisma Srl and the Customer must be considered concluded with the acceptance of the order by Crisma Srl. Crisma Srl has the right to accept or not, at its discretion, the order sent by the Customer, without that the latter can make claims or rights of any kind, including compensation, in the event of non-acceptance of the order itself. The acceptance of Crisma Srl is deemed tacitly released, unless otherwise communicated to the Customer within 24 hours of sending the order, by means of an e-mail message sent to the address communicated by the Customer.
Subsequently to the sending of the confirmation response by Crisma Srl, if Crisma Srl finds (due to technical or formal errors) the incorrectness of the price and / or characteristics, published on the Site, of the products that are objects of the Costumer's Proposal, Crisma Srl will expressly communicate this to the Costumer inviting him to make, if still interested, a new proposal.
By sending the order, the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept the General and Payment Conditions described below.
2. Products prices, delivery costs and products availabilities
All products prices are clearly indicated on the Site and are inclusive of VAT. They do not include any additional and different taxes or duties provided for by the relevant applicable laws, such as those envisaged for importation. If necessary, the Customer must therefore provide for the customs clearance of imports and to pay any duties and taxes (other than VAT) that may be due in the country of import.
If a product is presented on the Site in areas other than the specific sections intended for the purchase of products or in any case without the Add to cart icon, it is considered not available for sale through the Site.
The prices and availabilities of the products, as reported on the Site, are subject to change at any time and without notice, it being understood that, limited to orders that still have to be accepted or have been accepted by Crisma Srl, the current conditions of sale will apply at the time of sending the order by the Customer, except for orders not accepted, as indicated above.
The site shows the products available for shipping. This availability and the relative delivery times of the products are merely indicative, as they are not updated in real time; moreover, in consideration of the possible simultaneous order on the Site of the same product by several Customers or of the possible order, by the same Customer, of more specimens of the same product, the actual availability of the individual products may vary significantly during the same day compared to the indications on the Site.
If the delivery times of the ordered product are delayed with respect to the delivery times indicated on the Site before the order, Crisma Srl undertakes to promptly notify the Customer via an e-mail message to the address indicated by the Customer. Until the time of shipment by Crisma Srl, that is communicated to the Customer via email and through the updating of the information contained in the personal area, the Customer has the right at any time to cancel the order or modify it. This can only be done by following the specific procedures and technical functions listed in the personal area.
The cost of each shipment, the amount of which may vary based on the method of delivery and payment as well as the country of destination, is added to the total price of each Purchase Agreement and is clearly indicated and communicated to the Customer, through the Site and before the conclusion of the Purchase Agreement; the aforementioned shipping cost will also be specified in the Customer's personal area until the order has been processed.
The visual representation of the products on the Site, where available, normally corresponds to the photographic image of the products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment, by Crisma Srl, regarding the exact correspondence of the image shown on the Site with the actual product and this with particular regard to its actual dimensions and / or packaging.
In case of difference between the image and the written product sheet, the description of the product sheet always prevails.
3. Payments
Payments in execution of the Purchase Agreements stipulated through the Site can only be made through PayPal, or bank transfer. The Customer is required to choose the method of payment at the time of conclusion of the Purchase Agreement. The latter, once the Purchase Agreement has been finalized through the acceptance by Crisma Srl, can no longer be modified.
Notwithstanding the foregoing, if Crisma Srl encounters problems with the payment, it will promptly notify the Customer of the criticality encountered with regard to the execution of the payment, proposing to use another means of payment among those accepted by Crisma Srl.
3.1. Payments through PayPal
If the Customer chooses PayPal as a means of payment, he will be redirected to the website www.paypal.it where he will pay for the products according to the procedure envisaged and regulated by PayPal. The data entered on the PayPal site will be processed directly by the same and will not be transmitted or shared with Crisma Srl.
In the event of termination of the purchase contract and in any other case of refund, for any reason, the refund amount will be credited to the Customer's PayPal account. The times of re-credit on the payment instrument linked to this account depend exclusively on PayPal and the banking system. Once the credit order has been placed in favor of this account, Crisma Srl cannot be held responsible for any delays or omissions in crediting the Customer with the refund amount, to contest which the Customer will have to apply directly to PayPal.
3.2. Payment by bank transfer
The bank transfer for the payment of the purchased products must be prepared for the exact sum indicated at the time of completion of the Purchase Agreement and made out to:

The purchased products will be entrusted to the courier for shipment only after the amount has been credited to the current account of Crisma Srl. In the event that 8 days have passed without receiving the credit of the amount relating to the purchase, Crisma Srl will provide to independently cancel the order received.
4. Intellectual property rights
All trademarks (registered or unregistered), as well as any and all intellectual work, distinctive sign or denomination, image, photograph, written or graphic text and more generally any other intangible asset protected by international laws and conventions relating to intellectual property and industrial property reproduced on the Site remain the exclusive property of Crisma Srl and / or its assignors, without the Customer having any rights to the same from access to the Site and / or from the stipulation of the Purchase Agreements. Any use, even partial, of the same is prohibited without the prior written authorization of Crisma Srl, in favor of which all the related rights are reserved exclusively.
5. Applicable law and jurisdiction
The Purchase Agreement between the Customer and Crisma Srl is understood to be concluded in Italy and regulated by Italian law. For any controversy the Brindisi Judicial Authority will be exclusively competent.
